Snowmobile ban

Just read this on Yahoo news.

SPOKANE, Wash. - A judge has declared nearly 470 square miles of national forest land in northern Idaho off-limits to snowmobiles in an effort to save the last mountain caribou herd in the contiguous 48 states.
U.S. District Judge Robert H. Whaley, in a ruling Friday, banned the vehicles throughout a caribou recovery zone in the Idaho Panhandle National Forests until the U.S. Forest Service develops a winter recreation strategy taking into account the impact of the loud, exhaust-spewing devices on the herd.

Estimates of the herd in the Selkirk Mountains, which extend from Priest Lake, Idaho into British Columbia, run to about three dozen animals, a "precarious finger-hold" on survival, Whaley wrote.

Citing aerial photographs that show snowmobile tracks crisscrossing caribou routes to vital feeding areas, the judge added, "The court chooses to be overprotective rather than under-protective."

Environmental groups have sought to ban snowmobiles to protect the endangered animals, citing evidence that the noisy vehicles scare caribou from feeding and calving grounds. They also contend the compacted snowmobile trails and tracks allow predators to hunt caribou in the deep snow which normally offers them protection.

Snowmobile interests have countered that the herd has shrunk over the decades mostly because of past logging, backcountry skiing and global warming, adding that as few as two or three caribou from the herd have been seen south of the border in recent years.

The ban does not apply to hundreds of miles of state-owned land east of Priest Lake and offers a slim chance that limited snowmobiling might still be allowed in part of the recovery zone. Whaley gave environmental groups and the forest service a week to develop a proposal for a more trail-specific approach.

hmm.... no I dont see any biased writing....

ever consider that compacted snow helps the herd save energy?

Yeah that is what I was thinking, that doesn't make much sense to wait until the last minute.

Dont know about in the mountains but here in northern Michigan when the snow gets deep the deer and elk use the compacted snowmbile trails,a lot less effort to move on.Just keep your loud exhaust spewing sleds away from the deer and elk.
The elk are so stupid they just stand there and stare at your sled.

Exactly. Before some treehugger moved in and closed one of our trails we made a sidewalk for all the deer, taking them to an open freshwater spring. Fresh tracks laied down at 7:00 PM, nothing but deer tracks there by 11:00. Hurting them? Not a chance...

Just another example of a judge making law from the bench instead of doing his job.

Yea theere was a HUGe herd of Elk this past winter in the Gaylord Lewiston Atlanta area and i about Sh#% when I came around a corner in the middle of the night and just about ran smack dab in the middle of the herd. good thing for brakes. Then I just stoped and watched them and they were just a curious as i was and they looked at me while i watched them. pretty intimidating but what an experiance. there had to be 2 herds of a dozen each.

About 6 years ago I was riding down a twisty trail at night with my daughter on the sled came around a corner and there stood a 6x6 bull elk about 10 feet away
he just stood there for about 30 seconds or so and then walked of into the woods good thing I was only doing about 20 MPH

This says it all. From that quote I can surmise that the Judge is a "Tree Hugging Hippie"

Don't get me wrong, I tread lightly when I am out on my recreational toys, I have picked up garbage others left behind, and other environmently friendly things. I also agree that the Mountain Caribou need protection but there needs to be an impartial Judge to preside over this type of thing. As soon as you show bias, especially for a Judge, they should be taken off the case. We don't need lawmaking from the bench, just interpret the darn law.
I dont think the judge was biased here - to me it sounds like the reporter was. The judge can only work with thearguments set forth during the procedings. I would hasten to guess that there was not much put forth in evidence to say the sleds caused no harm to the habitat.

Remember folks - many of the Nazi greenies hold day jobs as the Park Rangers. What better way to control your interests than to be the ones in power.
Loud exhaust spewing devices...F'in enviro wackos!!!!! Yeah, the noise from motorized vehicles really hurts the wildlife doesn't it. It's the "silent" humans that the animals really need to worry about. Nothing against hunting but I just don't get how these hipocrits think that exhaust noise hurts the animals but a 12 guage shot gun doesn't???? If they realy want to help the environment they should align themselves with the far right that wants to seal the borders. This would actually help keep urban sprawl to a minimum. And if they have a problem with pollution they need to be going after large industry, not picking on a sport like ours that doesn't even represent a drop in the bucket so to speak.
